TRANSPARENCY PROGRAM AT THE "ALEKSANDER MOISIU" UNIVERSITY OF DURRA

I.  ENTRY

At the "Aleksandër Moisiu" University of Durrës (UAMD), in accordance with Article 7 of Law 119/2014 "On the Right to Information", a transparency program has been prepared, which consists of defining the basic rules of organization and functioning of the university in accordance with the legislation on higher education.

The transparency program at UAMD serves to increase the transparency, integrity and institutional accountability of the university according to the object and purpose of this law, taking into account the best interest of the public.

The publication of information through this program aims to serve the transparency of the organization and functioning as well as the mission and activity of UAMD and is achieved through the detailed publication of this information on the official website. www.uamd.edu.al as well as in public reception areas.

The transparency program is reflected in special sections that detail the way the university is organized, the main units of the institution, the authorities and governing bodies, special guidelines and sections for students, electronic access for students to register and to search for information in the system. A special section is also dedicated to the staff area which enables academic and administrative personnel to access the official website in order to obtain the necessary information accessible to them.

The transparency program also details the provision and publication of information regarding employment opportunities offered by UAMD, the application method for interested parties, privacy policies, periodic reporting of the university's economic and financial activity, etc.

Special attention is also paid to the publication of periodic announcements regarding scientific conferences as well as providing information regarding UAMD's participation in various projects as well as the publication of scientific research and international projects as well as scientific journals.

The content of the transparency program also includes the publication scheme, which consists of reflecting the main menus where the document is addressed and reflected on the official website, guaranteeing access to information in the scheme as well.

The official website of UAMD is built in such a way that it provides extensive information to the public without request and in an easily understandable format.

The information published in the transparency program is reviewed and updated in accordance with Article 5 of Law No. 119/2014.

The information published in the sections of the official website aims to make the activity transparent by informing the public while also respecting privacy policies in the protection of personal data.

II. GENERAL PRINCIPLES OF THE TRANSPARENCY PROGRAM AT UAMD.

  1. The transparency program at "Aleksandër Moisiu" University is based on the principle of the right to information, which is a constitutional right enjoyed by every person to be acquainted with public information in accordance with Article 3 of the Law on the Right to Information.
  2. The publication of information aims to guarantee maximum public knowledge of information and enables public access to information that is made public without a request in accordance with Article 7 of Law No. 119/2014 “On the Right to Information”.
  3. The organization and functioning of the university is characterized by the correct observance of the legislation and legal provisions that regulate the activity of higher education institutions and respectively: Law no. 80/2015 “On higher education and scientific research in higher education institutions in the Republic of Albania”, law no. 136/2015 on some additions and amendments to “On some additions and amendments to law no. 7961, dated 12.07.1995, “Labor Code of the Republic of Albania” as amended”, Code of Administrative Procedures, law no. 9367, dated 07.04.2005 “On the prevention of conflict of interest in the exercise of public functions”, as amended, law no. 9049, dated 10.04.2003 “On the declaration and control of assets, financial obligations of elected officials and certain public servants”, law no. 8480, dated 27.05.1999 "On the functioning of collegial bodies of state administration and public entities" in the statute of UAMD, the regulation and the University Code of Ethics as well as decisions or instructions regarding quotas, study fees, instructions regarding student admission criteria, transfers, information regarding study programs offered by UAMD, regarding curricula as well as regarding the rights or duties of students, student organizations, etc.

UAMD makes the following categories of information available to the public on its website and in public reception areas:

UAMD provides detailed information to the public through:

– Our website www.uamd.edu.al dhe numrave përkatës të telefonit.

–          The university administration, which, through the academic and administrative support staff of the Rectorate and the teaching secretaries at the respective faculties, provides information to students and interested persons according to the subject matter of the issue raised by them.

–           Displaying the lists of registered students as well as their assessment results in accordance with the principles of personal data privacy protection at the respective faculties.

–           Branch of External Relations and Projects. Written and audiovisual media should contact this Branch to exercise their activity in the premises of UAMD.

III. INFORMATION THAT BECOMES PUBLIC WITHOUT REQUEST

–           The organizational structure of the public authority;

–           The full texts of ratified conventions, laws, by-laws, codes of conduct, policy documents, manuals or any other document related to the exercise of its functions and affecting the general public;

–           Information on the procedures to be followed to make a request for information, the postal and electronic address for filing requests for information, as well as the procedures for appealing the relevant decision;

–           Data on the location of the public authority's offices, working hours, name and contact details of the coordinator for the right to information;

–           Data on the education, qualifications and salaries of officials who are required to declare assets by law, salary structures for other civil servants, as well as a description of the selection procedures, powers and duties of senior public authority officials and the procedure they follow to make decisions;

–           Monitoring and control mechanisms operating over the public authority, including strategic work plans, audit reports from the Supreme State Audit or other entities, as well as documents containing performance indicators of the authority;

–            Information on the budget and expenditure plan for the current and previous financial years, as well as any annual report on the implementation of the budget. In cases where the public authority is self-financed by licence fees or any other form of direct financing from the entities regulated by it, documents showing the status of the repayment of obligations by the licensed entities shall also be made public;

–           Information on procurement procedures or competitive procedures of concession/public private partnership, respectively, according to the provisions of Law No. 9643, dated 20.12.2006, “On public procurement”, and of Law No. 125/2013, “On concessions and public private partnership”, which are carried out on behalf of the public authority, including: the list of contracts concluded, the contracted amount, the contracting parties and the description of the contracted services or goods, information on the implementation and monitoring of contracts, as well as various guidelines and policies;

–           Information on the services that the authority provides to the public, including standards for the quality of service, a description of the categories and forms of social assistance, subsidies provided by the public authority and the procedures for obtaining them, information and documents that are frequently requested, any other information deemed useful by the public authority;

–           Any mechanism and procedure for making requests and complaints, regarding the actions or inactions of the public authority, the procedure through which interested persons may present their opinions or otherwise influence the drafting of laws, public policies or the exercise of the functions of the UAMD, a simple description of the system used by the public authority for maintaining documentation, the types, forms of documents, as well as the categories of information that is made public without request;

–            UAMD also creates and archives a digital copy of its official website, supplemented with the information required in the approved transparency program, as well as the methods, mechanisms and periodicity of publication of public information, which is made available to the public without request;

–           Acts containing rules, norms or restrictions on the fundamental rights and freedoms of the individual, as well as those with direct effect on them, are made public by displaying or posting on the official website, within 48 hours of the approval of the act by the UAMD.

The information published according to this scheme is updated whenever it changes.

V. PUBLICATION

In accordance with this approved transparency program, UAMD makes available to the public on its website www.uamd.edu.al and in public reception areas, the above categories, in a special menu entitled "Transparency Program".

 

VI. MONITORING

The Commissioner for the Right to Information and Personal Data Protection monitors the implementation of the law on the right to information, promoting the principle of transparency in the work of public authorities, particularly by raising awareness and informing on issues of the right to information.

The Commissioner makes recommendations to public authorities regarding the design and implementation of institutional transparency programs.
